ABSTRACT:

In October 2019, nine Catalan pro-independence political and civil society leaders were convicted for sedition and misuse of public funds for their support in organizing a peaceful referendum. Against international recommendations they were held two years in pre-detention and convicted to up to 13 years in jail. Today they remain banned from public office. What is the current situation in Catalonia?

The case of the leaders has helped uncover deficiencies in the Spanish judicial system. As their lawyers are bringing the complaints before the European Court of Human Rights we want to reflect on what these cases have meant for human rights in Europe. Examining the main structural problems, has their case created a chilling effect on freedom of expression rights in Catalonia? What is the current situation / what do we expect for the years to come? 

SPEAKERS:

Andreu Van den Eynde is a Barcelona-based criminal lawyer with 25 years of experience in criminal defense. He is professor of criminal law and cybercrime in the University of Barcelona and Catalan Open University. For the last 5 years he represented the defense of Catalan pro-independence politicians before both Spanish and international courts of justice. 

Clara Serra Baiget is a human rights lawyer with an LLM in European and International Human Rights Law. With experience at international courts, her work has mainly focused on international advocacy and human strategic litigation. For the past 2 years she has been part of a defense team of the Catalan pro-independence politicians.
